Terms of Service

IMPORTANT: This website contains content intended exclusively for adults (18+), including artistic photography containing nudity. By using the service, you confirm that you are 18 years of age or older and accept all provisions of these Terms of Service.

§1. General Provisions

1.1. These Terms of Service define the rules for using the "Artistic Photography Atelier" website (hereinafter referred to as the "Service"), available at fotografia.schoen.pl.

1.2. The owner and administrator of the Service is Artistic Photography Atelier.

1.3. The Service is an online platform for presenting and sharing artistic photography, including images containing nudes and nudity.

1.4. Using the Service means acceptance of all provisions of these Terms of Service.

§2. Age Requirements and Content Access

2.1. The Service is intended exclusively for adults who have reached the age of 18.

2.2. Minors may not use the Service. The Administrator is not responsible for minors' access to Service content.

2.3. The User confirms that they are 18 years of age or older and are fully aware of the nature of the content available on the Service.

2.4. The Service contains artistic photography that may depict nudes and nudity. All content is of an artistic and educational nature.

§3. Registration and User Account

3.1. To fully use the Service's features, the user must create an account through registration.

3.2. During registration, the user is required to provide true and current information.

3.3. The user is required to maintain the confidentiality of login credentials and bears full responsibility for all actions taken using their account.

3.4. The Administrator reserves the right to delete the account of a user who violates the Terms of Service.

3.5. The user may delete their account at any time by contacting the administrator.

§4. Content Publishing

4.1. Users may publish their own photos on the Service, provided that:

they are the authors of the photos or have appropriate rights to publish them,
the photos are of an artistic nature,
the photos do not violate the rights of third parties,
the photos do not contain illegal, offensive, or vulgar content.

4.2. It is prohibited to publish content:

of a pornographic or erotic nature (in the sense of exclusively sexual content),
promoting violence, hatred, or discrimination,
violating the copyrights of third parties,
containing images of persons without their consent,
of a commercial or advertising nature (without the administrator's consent).

4.3. The Administrator reserves the right to moderate and remove content violating the Terms of Service without prior notice.

4.4. The author is fully responsible for all content published on the Service. The author bears sole responsibility for the content, legality, compliance with the law, and copyrights of published materials. The Administrator is not responsible for content posted by users.

§5. Copyright

5.1. All content posted on the Service, including photos, texts, logos, and graphic elements, is protected by copyright.

5.2. By publishing photos on the Service, the user grants the Administrator a non-exclusive license to display them on the Service.

5.3. It is prohibited to copy, distribute, or use content from the Service without the consent of the Administrator or the copyright owner.

5.4. The user bears full responsibility for copyright infringement of third parties in connection with content published by them.

§6. Personal Data Protection

6.1. The Administrator processes users' personal data in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

6.2. Detailed information regarding the processing of personal data can be found in the Privacy Policy.

6.3. The user has the right to access their data, correct it, delete it, and object to processing.

§7. Liability

7.1. The Administrator will make every effort to ensure the Service operates correctly, however, is not responsible for:

interruptions in Service operation caused by technical failures,
loss of user data,
damages resulting from using or inability to use the Service.

7.2. The User (author) bears full and exclusive responsibility for all content published by them on the Service. This includes civil, criminal liability, and liability for violation of third-party rights, including copyrights, image rights, personal rights, and other property and non-property rights.

7.3. The Administrator is not responsible for content posted by users, but reserves the right to moderate and remove it. In case of third-party claims related to content published by a user, the user undertakes to release the Administrator from all liability and cover all costs related to such claims.

§8. Rules for Using the Service

8.1. The user undertakes to use the Service in a manner consistent with the law and good customs.

8.2. It is prohibited to:

attempt to hack into the system or violate Service security,
use automated scripts to download content,
publish misleading or false content,
violate the privacy of other users,
use the Service for purposes inconsistent with its intended use.

§9. Changes to the Terms of Service

9.1. The Administrator reserves the right to make changes to the Terms of Service.

9.2. Users will be informed of changes to the Terms of Service by publishing a new version of the Terms of Service on the Service.

9.3. Continued use of the Service after changes are made means acceptance of the new Terms of Service.

§10. Final Provisions

10.1. Matters not regulated in these Terms of Service shall be governed by Polish law.

10.2. All disputes arising from the use of the Service will be resolved by competent Polish courts.

10.3. The Administrator reserves the right to temporarily or permanently block access to the Service for users who violate the Terms of Service.

10.4. In case of violation of the Terms of Service, the Administrator may take legal action against the user.
